It is true thatyou are the sole judges of the facts, but the law as he gives it mustgovern and guide you in coming to your conclusion. (Here counsel after remarking on the pleasant relations which hadexisted through the trial among all parties concerned, and on thegood-will with which the Court granted every possible indulgence, con-cluded as follows:) May you in your deliberations come to such a conclusion that youwill say to his mother that her boy is the same as he has ever been, aChristian youth, a Christian gentleman, wedded to his home, weddedto all of his family. Let the flashes of lightning go over land and under seas to thatwaiting and anxious sister, to say that her brother Theo is the samegood and upright man that he ever was. Say by your verdict to this broken-hearted father, crushed by theawful wrong the law has done to his and to him, that his son is not amonster.

THE DURRANT CASE. 165 Gentlemen of the jury, let it be said by your verdict that no un-licensed condition of the press may swerve you one moment from thetruth. Let it be known to the public and the commonwealth through-out the United States and the world at large that you, as citizens ofthis city and county, respect the Constitution of the United States,and revere the organic law of your own State, which gives every mana right to a fair and impartial trial, and by your verdict of not guilty,show forever that you are mindful of your duty to yourselves, yourfamilies, your country and your God. At this point the Court adjourned until the next morning, Wednes-day, October 30th, at 10 oclock, at which time the District Attorney,Honorable William S.
